North Dakota Introduces Medical Cannabis Edibles

In a significant development for medical cannabis patients, North Dakota has approved the introduction of edibles, expanding options for treatment beyond flowers, concentrates, and tinctures. Following the passage of the “North Dakota Compassionate Care Act” in November 2016 and the establishment of a medical marijuana program the following year, the program has seen substantial growth, with over 10,437 registered patients as of April 2023.

Governor Kelly Armstrong recently signed HB1203, which mandates strict regulations for cannabis edibles. Edibles will be limited to geometric square-shaped lozenges, made with either cannabinoid concentrates or dried cannabis plant material, aimed at minimizing appeal to minors. The legislation restricts the maximum THC content to five milligrams per serving and fifty milligrams per package, with all packaging required to be child-resistant, resealable, and non-transparent.

Representative Steve Vetter, the bill’s primary sponsor, emphasized that this law represents one of the most conservative approaches in the nation regarding edibles, designed to provide safer options for patients. Despite a push for recreational marijuana legalization, a recent ballot initiative was defeated, with 52.53% of voters opposing it.
