North Dakota Judge Overturns Abortion Ban, Upholds Women’s Rights
A North Dakota district judge has invalidated the state’s stringent near-total abortion ban, emphasizing that it contravenes the state constitution and reaffirms women’s fundamental rights to abortion prior to fetal viability. District Judge Bruce Romanick’s ruling comes after the Red River Women’s Clinic challenged the law, which had set limited exceptions for abortion in cases of maternal life threat, and restricted access for rape and incest survivors to just six weeks of pregnancy.
In his decision, Judge Romanick asserted that the legislation infringed "on a woman’s fundamental right to procreative autonomy," and criticized the law for not being "narrowly tailored to promote women’s health or to protect unborn human life." He pointed out the lack of any compelling interest from the state to mandate that women carry pregnancies to term, underscoring that the law impedes women’s liberty in seeking safety and happiness.
While the order has yet to take effect and an appeal is anticipated, North Dakota currently has no abortion providers following the relocation of the Red River Women’s Clinic to Minnesota due to the ban. The clinic claimed the law was constitutionally vague regarding exceptions and expressed satisfaction with the ruling. “It’s a good day for North Dakota’s pregnant people,” said Tammi Kromenaker, the clinic’s director.
Despite the ruling, the state’s attorneys had argued for the dismissal of the case on grounds of standing, contending that the clinic’s relocation nullified its claims. The legal landscape surrounding abortion in North Dakota shifted dramatically after the US Supreme Court overturned Roe v. Wade in 2022, leaving states to establish their regulations. Governor Doug Burgum previously described the revised ban, enacted in April 2023, as a reaffirmation of North Dakota’s pro-life stance.
