North Dakota Senate Considers Special Legislative Session Scenarios

BISMARCK — North Dakota Senate Majority Leader David Hogue motioned for a briefing on potential scenarios that could trigger a special legislative session, following discussions on interim committee study topics such as state employee compensation and homelessness.

Hogue, a Republican from Minot, highlighted five primary scenarios warranting such a session. The Legislative Management Committee can convene the legislature, but any session would deduct from the 80 days available biennially. Currently, six days remain after the 2025 regular session, while the governor can call sessions without this restriction.

The first scenario involves possible legislative action following a federal court ruling on the state’s legislative redistricting, previously deemed unconstitutional but recently reinstated. A challenge to legislative vetoes, particularly concerning the accidental elimination of $35 million for housing assistance in a veto, serves as the second scenario. Other situations include drastic fluctuations in oil prices, legal issues surrounding the Dakota Access Pipeline, and potential cuts in federal funding critical for state and local projects.

Hogue indicated that the Legislative Council would provide necessary details at the next management meeting, crucial for lawmakers to evaluate these situations effectively. No date for the next meeting has been set.
