Federal Appeals Court Halts Rulings on Trump Tariffs, Permitting Continuation — For Now


A federal appeals court has temporarily halted rulings from the U.S. Court of International Trade that had suspended several tariffs imposed by President Donald Trump on international trading partners. The U.S. Court of Appeals for the Federal Circuit will consider legal arguments regarding whether this stay should continue until at least June 9. Jeffrey Schwab, representing the plaintiffs, characterized the ruling as simply a procedural move. In contrast, officials in the Trump administration, including National Economic Council Director Kevin Hassett, hailed the decision as a significant win for the president.

Legal advisors in the administration, like Peter Navarro, emphasized that the government would explore alternative methods to maintain the tariffs, even if unsuccessful in court. The original ruling from the Court of International Trade challenged the authority of Trump to impose unbounded tariffs under the International Emergency Economic Powers Act, which has rarely been used in this manner by past presidents. A separate ruling by U.S. District Judge Rudolph Contreras in Washington, D.C. found many of Trump’s tariffs “unlawful,” stating that the President did not have the power to unilaterally impose tariffs as a means to manage the economy.

Contreras noted that previous presidents never utilized the IEEPA for tariff imposition, asserting that granting such power may undermine congressional authority. He outlined the adverse effects of blocking tariffs, including potential embarrassment on the global stage and risks to national security. Ultimately, the administration is actively appealing both rulings, arguing that they jeopardize ongoing trade negotiations and U.S. foreign policy.
